About this Notice

Progress Software Corporation, together with all of its affiliates and subsidiaries (“Progress”) provides this Candidate Privacy Notice (the “Notice”) as part of its continuous effort to comply with the EU General Data Protection Regulation (“GDPR”). It is important for you to understand how Progress collects, processes, and stores your personal data in relation to your candidacy for employment.

This page provides additional details on Progress’ privacy practices associated with the submission and processing of personal information submitted by job applicants ("candidates").

Collection, Use and Sharing of Your Personal Information

Progress will be the controller of your data for the purposes of your application, administration, resource management, etc. Local hiring legal entities are data controllers for local recruitment, on-boarding, and any subsequent employment-related processing. Progress will process candidate personal information for recruitment purposes (as explained below). In addition, your data may be used to comply with Progress’ legal, regulatory and corporate governance requirements. Once a candidate is hired by Progress, the employee’s personal information for the duration of employment is covered by the Progress Employee Privacy notice.

However, if you accept an offer of employment from Progress, any relevant personal data collected during your pre-employment period will become part of your personnel records and will be retained in accordance with specific country requirements and Progress’ Employee Privacy Notice. If we do not employ you, we may nevertheless continue to retain and use your personal data for a period of time (which may vary depending on the country) for system administration purposes, to consider you for potential future roles, and to perform research. If you do not want to be considered for other positions or would like to have your data removed, you may contact Progress as specified below. Unless required for tax or other legal purposes or in connection with employment as specified above, your data will only be retained for as long as it is needed for the purposes outlined in this Notice (or less where required by law).

As mentioned above, “recruitment purposes” include communicating with you, internally evaluating your qualifications and skills, preparing for interview or screening discussions (including arranging travel where applicable or reimbursing candidates for expense), and may entail background checks for certain roles which will be conduct with additional notice and in accordance with applicable laws. Resumes submitted to Progress for review should only include information relevant to job qualifications and employment history including prior employment, relevant positions and dates, significant accomplishments, education, degrees or certifications obtained, dates and issuing institutions and other relevant awards or achievements. During the hiring process we may obtain information about you from publicly available sources or from third parties including references, background check suppliers, and the like, to the extent allowable by law. We take steps to confirm that information we receive from these third parties has been collected with your consent or that these parties are otherwise legally permitted to disclose your personal information to us.

Legal Basis and Data Protection Rights

We use a combination of legitimate interests, performance of a contract (including the intention to enter into a contract) and/or consent as the legal basis to process the personal information that you share with us as part of the recruitment process.

Candidates in the EEA can object to processing of their personal information, ask us to restrict processing of their personal information or request portability of their personal information. Where consent to the use of personal information has been obtained, it can be withdrawn at any time with future effect; however, withdrawing consent will not affect either the lawfulness of any processing we conducted prior to the withdrawal, or the processing personal information under other legal bases.

For personal information originating in the European Economic Area (EEA) that is transferred to a Progress entity outside the EEA that does not have an “adequate level of protection” as determined by the European Commission, Progress does so on appropriate safeguards for the transfer of EU Personal Information moving forward.

Your Choice and Rights

You have rights to correct, update, request access to or deletion of your personal information. See the Contact Us section below for information about how to do this. In addition, if you wish to update or otherwise make changes to your resume, simply resubmit a new resume. If you wish to have your resume completely removed from Progress’ systems, please send an email to: Privacy@progress.com.
